Art. 1. GENERAL PROVISIONS

  1. These General Terms and Conditions (hereinafter “GTC”) govern the rights and obligations related to purchases made in the online store https://www.mariacavallo.com/obchod/.
  2. The purpose of these GTC is to define and clarify the rights and obligations of the Seller and the Buyer when concluding a distance purchase contract.
  3. The operator of the e‑shop and the Seller is:

  4. The Seller is entitled to amend these GTC. The new version becomes effective on the day of publication. Contracts concluded before the effective date of the new GTC are governed by the GTC valid at the time of their conclusion.

Art. 2. DEFINITIONS

  1. Seller – the operator of the e‑shop.
  2. Buyer – a natural or legal person who has submitted an electronic order.
  3. Consumer – a natural person who does not act within the scope of business activities.
  4. Goods – products listed in the e‑shop offer.
  5. Electronic order – a submitted electronic form containing Buyer information, a list of ordered goods, and the price.
  6. E‑shop – the Seller’s online store at https://www.mariacavallo.com/obchod/.

Art. 3. ORDERING GOODS

  1. Orders may be placed via the shopping cart, by email, or by phone.
  2. A condition for a valid order is the truthful completion of all required information.
  3. The order constitutes a proposal for a purchase contract. The contract is concluded upon confirmation of the order by the Seller (status “processing”). An automatic email confirming receipt of the order is not considered confirmation.
  4. Order cancellation:
    The Buyer may cancel the order until the moment the shipment is dispatched.
    Exception: goods made to order (non‑standard size or variation).
  5. By submitting the order, the Buyer confirms that they have read and agree to these GTC.
  6. Legal relations not governed by these GTC are subject to the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, and Act No. 22/2004 Coll. on Electronic Commerce.

Art. 4. DELIVERY OF GOODS

  1. The Seller’s obligation to deliver the goods is fulfilled when the goods are received by the Buyer or handed over to the carrier.
  2. The Buyer is obliged to accept the goods. If this is not possible, the Buyer must inform the Seller without delay.
  3. The Seller shall deliver the goods no later than within 30 days unless otherwise agreed.
  4. The Buyer may withdraw from the contract without an additional period if:
    a) the Seller has refused to deliver the goods,
    b) timely delivery was essential,
    c) the Buyer informed the Seller in advance that timely delivery is essential.
  5. Goods are delivered by courier or to a pickup box.
  6. If the Buyer does not accept the goods and the shipment is returned, the Seller may withdraw from the contract and claim reimbursement of delivery costs.
  7. In the case of partial delivery, the Buyer pays shipping only once.

Art. 5. PURCHASE PRICE AND PAYMENT TERMS

  1. The Buyer is obliged to pay the price listed in the e‑shop at the time of submitting the order.
  2. Shipping costs:
    • personal pickup: free of charge
    • courier / pickup box – according to prices listed in the e‑shop
  3. The Seller reserves the right to change prices. The price in the confirmed order is binding.

Art. 6. COMPLAINT CONDITIONS

Complaints are governed by a separate document, the Complaint Policy, published on the e‑shop website.

Art. 7. WITHDRAWAL FROM THE CONTRACT (RETURN OF GOODS)

Returns are governed by a separate document, the Return Policy, published on the e‑shop website.

Art. 8. ALTERNATIVE DISPUTE RESOLUTION (ADR)

The Consumer has the right to contact an ADR entity, such as the Slovak Trade Inspection.

Art. 9. PERSONAL DATA PROTECTION

The processing of personal data is governed by the Privacy Policy, available on the e‑shop website.

Art. 10. FINAL PROVISIONS

These GTC are valid and effective from the date of their publication on the e‑shop website.
